Terms of Service

These Terms of Service ("Terms") govern your use of the HQPDcontrol mobile application ("the App"), operated by Aleš Procházka ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Description of Service

HQPDcontrol is a mobile remote control application for HQPlayer Desktop and HQPlayer Embedded, audio playback software developed by Signalyst. The App provides:

• Browsing and searching your HQPlayer music library.
• Playback control (play, pause, stop, skip, seek, volume).
• Managing the playback queue and playlists.
• Configuring HQPlayer audio processing settings.
• Audio analysis and real-time metering.
• Integration with the HIGHRESAUDIO (HRA) streaming service.

The App is a remote control — it does not play, stream, or process audio itself. All audio playback is performed by your HQPlayer instance.

2. Requirements

To use the App, you must have:

• A device running Android 7.0 (API 24) or later, or iOS 16.0 or later.
• A running instance of HQPlayer Desktop or HQPlayer Embedded accessible on your local network.
• A valid HQPlayer license (obtained separately from Signalyst).

For the HRA streaming feature, you must additionally have your own active HIGHRESAUDIO streaming subscription, obtained directly from HIGHRESAUDIO.

3. Subscription and Payments

3.1 Subscription Model

Access to the App requires an active subscription. We offer monthly and annual subscription plans. Subscriptions are billed through the Apple App Store or Google Play Store, depending on your platform.

3.2 Free Trial

We may offer a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the applicable rate.

3.3 Billing and Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your app store account will be charged for renewal within 24 hours prior to the end of the current period.

3.4 Cancellation

You may cancel your subscription at any time through your app store account settings (Apple App Store or Google Play Store). Cancellation takes effect at the end of the current billing period — you retain access until then. We do not offer prorated refunds for partial billing periods.

3.5 Refunds

Refund requests are handled by the respective app store according to their refund policies:

• Apple App Store: Request a refund from Apple
• Google Play Store: Request a refund from Google

3.6 Price Changes

We reserve the right to change subscription prices. Any price change will take effect at the start of the next billing period following notice of the change, as required by the respective app store.

4. User Responsibilities

• You are responsible for maintaining a working HQPlayer installation and network configuration.
• You are responsible for the security of your own network and HQPlayer instance.
• You are responsible for any streaming service credentials you enter into the App.
• You must not use the App for any unlawful purpose or in violation of any applicable laws.
• You must not attempt to reverse-engineer, decompile, or disassemble the App beyond what is permitted by applicable law.

5. Intellectual Property

The App, including its design, code, and visual assets, is the intellectual property of Aleš Procházka. Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

HQPlayer is a trademark of Signalyst. HIGHRESAUDIO is a trademark of HIGHRESAUDIO GmbH. These trademarks are used for identification purposes only and do not imply affiliation or endorsement.

6. Third-Party Services

The App integrates with third-party services that are governed by their own terms:

• HQPlayer — developed by Signalyst. Subject to the Signalyst license terms.
• HIGHRESAUDIO — subject to the HIGHRESAUDIO Terms of Service.
• Apple App Store / Google Play Store — subject to their respective terms of service.

We are not responsible for the availability, functionality, or content of third-party services.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The App will be uninterrupted, error-free, or free of harmful components.
• The App will be compatible with all HQPlayer versions or configurations.
• Streaming service integrations will remain available (these depend on third-party APIs outside our control).
• Audio quality or playback behavior will meet specific expectations (this depends on your HQPlayer configuration and hardware).

8. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the App.

Our total aggregate liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App subscription in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

9. Termination

We may suspend or terminate your access to the App if you violate these Terms. Upon termination, your license to use the App is revoked. Sections 5, 7, 8, and 10 survive termination.

You may terminate your use at any time by cancelling your subscription and uninstalling the App.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.

If you are a consumer residing in the European Union, you also enjoy the protection of the mandatory consumer protection provisions of your country of residence. In addition, you may bring proceedings before the courts of your country of residence.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the App after changes constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify you through the App or the app store.
